Terms of Service

These terms govern use of the AnswerBay service, operated by Anthony M. Emberley (“we,” “us”). By using the service you agree to them.

1. What the service does

AnswerBay answers phone calls for an auto repair shop, takes down what the caller needs, and sends transactional text messages such as confirmations and summaries. It is an assistant, not a replacement for the shop’s judgment. Appointment times, prices, and repair decisions are confirmed by the shop.

2. Accounts and eligibility

The service is for businesses. You must be authorized to act for the shop, to configure how its phone is answered, and to enroll its phone numbers.

3. Your responsibilities

Give us accurate shop information (hours, services, policies). The service answers using what you tell it.
Do not use the service to send marketing, promotional, or unsolicited messages.
Comply with applicable law, including call-recording and telemarketing rules in your state.
Tell us promptly if any information the service is giving out is wrong.

4. Messaging

Only transactional messages are sent. Recipients may reply STOP to opt out or HELP for help. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy.

5. Fees, term, and cancellation

Pricing is stated at signup. Service is month to month with no contract — you can cancel any day, and cancellation stops future charges. Turning the service off is a single code you dial on your own phone; you do not need us to leave.

6. Availability

We work to keep the service running but do not guarantee uninterrupted or error-free operation. Telephony, network, and third-party outages can occur.

7. Disclaimers and limitation of liability

The service is provided “as is,” without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost business or lost profits.

8. Termination

Either party may stop the service at any time. We may suspend or terminate an account for misuse, non-payment, or legal risk.

9. Changes

We may update these terms; the date above will change. Continued use after an update means you accept it.

10. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
